Objects and functions of the Service
- The objects of the Service are to-
- implement approved national policies for health delivery in the country;
- increase access to improved health services; and
- manage prudently resources available for the provision of health services.
2. For the purpose of achieving its objects, the Service shall perform the following functions-
- ensure access to health services at the community, sub-district, district and regional levels by providing health services or contracting out service provision to other recognized health care providers;
- set technical guidelines to achieve policy standards set by Ministry;
- plan, organize and administer comprehensive health services with special emphasis on primary health care;
- develop mechanisms for the equitable distribution of health facilities in rural and urban districts;
- manage and administer health institutions within the service;
- contract with teaching hospitals for the treatment of referred patients;
- promote health, mode of healthy living and good health habits by people;
- establish effective mechanisms for diseases surveillance, disease prevention and control;
- promote the efficiency and advancement of health workers through in-service and continuing education;
- manage the assets and properties of the Service to ensure the most effective use of them;
- determine, with the approval of the Minister charges for health services rendered by the service;
- perform any other function that is relevant to the promotion, protection and restoration of heath.
Governing body of the Service
- The governing body of the Service shall be known as the Ghana Health Service Council referred to in this Acts as “the Council”.
- The Council shall consist of –
- a chairman who shall be a person with considerable experience in management and administration but who shall not be a Minister or Deputy Minister.
- the director – General of the Service appointed under section 11 of the Act;
- a representative of the Ministry of Health;
- a representative of the Ministry of Finance;
- a representative of the Ministry of Education;
- a representative of the Ministry of Local Government and Rural Development;
- A representative of the Health Workers Union of the T. U. C.; and
- Five other persons who by their knowledge and experience can contribute to the work of the Council, at least two of whom shall be women.
- The Chairman and the other members of the Council shall be appointed by the President in consultation with the Council of State.
The Council shall have general control of the management of the Service and shall-
- ensure the implementation of the functions of the Service;
- submit to the Minister recommendations for health care delivery policies and programmes;
- promote collaboration between the Ministry of Health, the Teaching Hospitals and the Services;
- advice the Minister on the qualification for posts in the Service; and
- advice the Minister on such other matters as the Minister may request.
APPOINTMENTS AND PROMOTIONS COMMITTEE
The Ghana Health Service and Teaching Hospitals Act. 1996 (Act.525) mandates the appointment of an Appointments Committee.
The Appointment Committee shall be responsible to the Ghana Health Service Council.
The functions of the Appointment Committee shall be:
- Advice Council on the proposals for appointment and promotions presented to the council by the Director – General of the GHS.
- Review and provide advice to Council on the Human Resources, Annual Recruitment and Promotions Plan of the GHS.
- Review cases related to promotion and appointments of the staff in GHS as referred to it and make recommendations to the Council.
- Any other matters in relation to appointments, promotions and disengagement that may be referred to it.
The Appointments Committee shall meet quarterly. Emergency/special meetings shall be called as and when necessary.
Tenure of Office:
Members of the Appointment Committee shall serve for a period of four (4) years and shall be eligible for re-appointment.
The composition of the Appointment Committee shall be determined by the Council. It shall comprise members and non – members of Council. A member of Council on the Committee shall be appointed Chairman of the Committee.
Membership of the Appointments committee shall include;
- Chairman -
- Council member,
- Representative from Health Workers Group
- Director, Human Resources Division
- A Regional Director of Health Services
- Secretary to Council
Co - option
Committee may co-opt any person in furtherance of its functions.
With the coming into force of the Ghana Health Service, and the institution of the Internal Audit Division (IAD), there is the need, as stipulated in the Internal Audit Manual, to form an Audit Committee. The Audit Committee will assist the council in discharging its legislative duties to exercise a general control over the management of the Service.
Members of the Council are supposed to pass a resolution in establishing the Audit Committee.
The primary responsibility of the Audit Committee is to perform a vigilant oversight of the financing, reporting and auditing activities of the Service on behalf of the Council. In carrying out its functions, the Committee must maintain open lines of communication with the Director – General, Director IAD, Auditor-General, Private Sector, External Auditors, and the Council.
The major duties of the committee include:
- Select / discharge annually, the GHS independent private sector External Auditors in consultation with the Auditor – General.
- Review the scope and fees proposed by these auditors.
- Review the result of their audit.
- Review annually, the GHS Internal Auditing Charter.
- Review IAD’s proposed annual work plan and budget.
- Meet with the Director, IAD at its quarterly meetings and privately as required, to review the result IAD activities.
DISCIPLINARY AND WELFARE COMMITTEE
The Ghana Health Service and Teaching Hospitals Act, 1996 (Act 525) mandates the appointment of the Disciplinary Committee of the Ghana Health Service Council.
The Disciplinary Committee is responsible to the Ghana Health Service Council.
- Advice Council on disciplinary matters as may be referred to the Council (by the Director – General).
- Review and advise Council on the disciplinary codes and procedures operating within the GHS.
- Investigate and sit on cases of breech of discipline and make appropriate recommendations to the Council.
- To be involved in the production, dissemination and monitoring of disciplinary code of conduct within the Service.
- To liaise with various Professional Councils/Boards in matters relating to discipline.
- Other duties as may referred to the Committee by the Council.
The Disciplinary Committee shall meet quarterly as and when necessary.
Tenure of Office:
Members of the Disciplinary Committee shall serve for a period of four (4) years and shall be eligible for re-appointment.
The Council shall determine the Composition of the Disciplinary Committee. It shall comprise at least seven members including three non-members of the Council. A member of Council shall be appointed chairman of the Committee.
Membership of the disciplinary committee shall comprise:
- Council Member; Chairman –
- GHS Legal Officer/Nomination from the Attorney General’s Department
- The representative of the Health Workers Union of TUC on Council
- Director, Human Resources Development
- Deputy Director – General
- Representative of Health Professional Association to which the staff belongs as a non-voting member
- Co-option – Secretary to Council
FINANCE AND BUDGET COMMITTEE
The Ghana Health Service and Teaching Hospitals Act, 1996 (Act. 525) mandates the appointment of the Finance and Budget Committee of Council.
The Finance and Budget Committee is responsible to the Ghana Health Service Council.
The functions of the Finance and Budget Committee shall include:
- Receive and review the annual Programme of Work of the GHS and make recommendations to Council for endorsement
- Advise Council on the reasonableness of the annual and any medium-term POW of the GHS to meet, set priorities and programmes of the GHS
- Advise Council on options for mobilizing funding of the GHS
- Review quarterly financial performance of the GHS to ensure that actual expenditure is in line with budgeted expenditure
- Make recommendations to Council on ways of ensuring efficient use of budgeted resources
- Advise Council on all financial matters that Council may refer to it
- Advise on modalities for effective collaboration with the District Assemblies and Regional Coordinating Councils.
The Finance and Budget Committee shall meet at least once every two (2) months.
Tenure of Office:
Members of Finance and Budget Committee shall serve for a period of two (2) years and shall be eligible for re-appointment for another two-year term.
The composition of the committee shall be as determined by council. It shall comprise members and non-members of Council shall be the Chairman of the committee. Membership of the committee shall comprise the following:
- Director Finance - GHS
- Director PPME - GHS
- Director – SSDM - GHS
- An Economic (Private) or a social Sector Analyst
- A Private Accountant
- A regional Director of Health Services
- A District Director of Health Services.
- A secretary
